It is getting to be just about time to remind the feds who they work for. All the rules written by the US founding fathers about changing or abolishing a government that no longer serves the people By Any Means Necessary are there for a reason.

A Federal No-Fly Zone Over Texas?

Proving that the extortionist tendencies of the Obama administration aren’t limited to the NLRB’s suit against Boeing, the Department of Justice threatened the state of Texas with a complete suspension of air travel in and out of that state if its Senate approved HB 1937, a bill which would have banned “intrusive touching of persons seeking access to public buildings and transportation.” The penalty for doing so would have been a $4,000 fine and one year in jail. Authored by Representative David Simpson (R-Longview), and passed in the House by a vote of 138-0, HB 1937 was the first bill in the country designed to derail the TSA’s intimate pat-downs absent the probable cause guaranteed by the Fourth Amendment. As of now, the bill is dead.
A letter signed by U.S. District Attorney for Western Texas, John E. Murphy, is the epitome of coercive innuendo. Sent to House Speaker Joe Straus, Lieutenant Governor David Dewhurst, and the House Clerk and the Senate Secretary, the letter warned these officials of the “significant legal and practical problems that will be created if the bill becomes law,” noting that “the intent of the bill is to preclude a [federal transportation official] from turning away from the secure area of an airport someone who otherwise would have been subjected to a pat down as a condition of entry.” Murphy then warned Texans that if the Senate chose to enact the bill, “the federal government would likely seek an emergency stay of the statute. Unless or until such a stay were granted, TSA would likely be required to cancel any flight or series of flights for which it could not ensure the safety of passengers and crew.”
Senate sponsor Dan Patrick (R-Houston) was undeterred. Initially believing he had the votes to pass the bill, he pressed on, angrily noting that “I don’t cave in to heavy handed threats by the federal government.” Lieutenant Governor Dewhurst allowed the legislation to proceed to the floor of the Senate for debate. At that point, support wavered, and Patrick withdrew the bill.
One of the senators who withdrew his support was Juan “Chuy” Hinojosa (D-McAllen), who had voted in favor of the bill in committee. Mr. Hinojosa said that while he agreed with Patrick on principle he couldn’t vote for a measure that supersedes federal law. “The bill makes it a crime for a [federal TSA employee]…to perform a federal screening that he or she is required by federal law to perform,” he said. Another dissenter, Sen. John Whitmire (D-Houston), concurred. ”I would hate for 181 members of the legislature to think that they can override the concerns of the TSA officials. In fact, I know state law cannot override federal measures,” he said.
Yet Sen. Patrick blamed the failure on fellow Republican Dewhurst. “When you stand on the Senate floor and the president of the Senate calls the bill up, he’s not supposed to be working against the bill while you’re debating it,” Patrick fumed. “This was a case of the federal government bullying Texas, and apparently they bullied the lieutenant governor.” In a column for the Ne Tarrant Tea Party website, the Senator elaborated: “I had 30 of 31 Senators in support in the morning, but the Lt Gov waited until late in the afternoon for a letter from TSA that threatened Texas. He them (sic) called our bill up around 10 p.m. and while I was on the floor debating the bill he was working to kill the bill according to Senators who talked with me later. This is a time to stand up for our liberty and freedom and not be bullied by the feds. Apparently the Lt. Gov was bullied…[and] caved to the feds’ threats.”
Dewhurst spokesman Mike Walz disputed that assessment. “That’s completely inaccurate,” he said, noting that while Hinojosa was speaking, another senator, kirk Watson (D-Austin), approached the Lieutenant Governor with a list of 12 Senators who had changed their minds after becoming aware of the DOJ’s intentions to close airports or cancel flights. Walz said Dewhurst was still willing to bring the bill to the floor in spite of the letter, believing the senate would pass it regardless.

Patrick wasn’t buying it. After admitting legislators changing their minds “happens sometimes,” he reiterated that he had far more votes than the 21 necessary to pass the legislation. ”It sometimes happens when you have 21, but not when you have [30],” Patrick said, adding that Dewhurst should have “just told me” and not bothered to bring the bill up at all.
Speaking with Capitol Press Corps members on the Senate floor, Patrick said it wasn’t just the threatening letter which swayed Dewhurst. ”Two TSA people” contacted the senator earlier in the day, he revealed. ”They told me if we pass this bill, this could close down all the airports in Texas,” he said, also criticizing their last minute efforts to kill the legislation. ”They’ve had this entire session to speak out on this issue, and we haven’t heard from the federal government,” he added. Texas newspaper the Star-Telegram disputed that account, saying the TSA had “actively campaigned against the measure for weeks.”
House sponsor Simpson noted in a press release on Thursday that “94 House members from both parties coauthored the bill, and the Senate has registered both a Republican and a Democrat as sponsors.” Simpson went on to dispute the federal government’s contention that the law, if enacted, would have violated the Supremacy Clause of the United States Constitution, which posits that federal law supersedes state law if there is a conflict between the two. Simpson disputed that finding. “The bill clearly states that an agent is exempt from prosecution as long as a constitutionally sanctioned federal law directs them to perform the invasive, indecent groping searches-including touching breasts, sexual organs and buttocks,” he said. He then honed in on the heart of the dispute. ”Instead of threatening to shut down flights in Texas, why doesn’t the TSA just show us their statutory authority to grope or ogle our private parts?” he asked.
That sentiment was echoed by Michael Boldin of the Tenth Amendment Center who contends the TSA is “lying” with regard to the Supremacy Clause, noting that while federal law does trump state law when the two are in conflict, federal law must be “in pursuance of” the Constitution in order to be valid. Boldin further cites the Virginia Resolution of 1798, in which the states, when faced with “palpable and alarming infractions of the Constitution” by the federal government “are in duty bound, to interpose for arresting the progress of the evil, and for maintaining within their respective limits, the authorities, rights and liberties appertaining to them.”
Regarding the over-reach of the TSA, Texas is not alone. On April 12, 2011, the Alaska state legislature sent a letter to the Senate Committee on Homeland Security and Governmental Affairs requesting an oversight hearing in Alaska on the “TSA’s current practice of conducting pat-down searches and other security procedures on airline passengers.” The letter was engendered by Rep. Sharon Cissna’s (D-Anchorage) personal experience with the TSA. Cissna, a breast cancer survivor, objected to what she believed to be an overly invasive search when TSA screeners in Seattle insisted on examining the area where an electronic body scan revealed her mastectomy scars. Cissna refused and took a boat to Juneau instead.
One suspects that, if more of the political class were subjected to these procedures — and to a significant extent they are not (see: http://www.theblaze.com/stories/so-which-government-officials-get-to-skip-tsa-security-checks/ )— such people might be inclined to reconsider TSA security procedures. As for the Lone Star state, the motto “don’t mess with Texas” rings a bit hollow right now. Just as hollow as U.S. Attorney John E. Murphy’s threat to cancel thousands of flights grounding hundreds of thousands of passengers, which would undoubtedly spawn numerous lawsuits from airline companies and anyone else affected. The Texas legislature ends its current session on May 30th. As of now they have no intention of revisiting HB 1937. In the age of Obama, federal thuggery has never been so easy. |

Texans Take to Capitol, Demand Representatives Resist TSA Tyranny
Infowars: (Paul Joseph Watson and Kurt Nimmo) Earlier today, Alex Jones went to the Texas State Capitol in Austin and joined a protest of citizens gathered to demand an end to TSA tyranny.
On his nationally syndicated radio show, Alex urged all within a reasonable distance of the capitol to take part in the demonstration. More than 200 people did so.
They implored their elected representatives to resist the federal government and its threat to shut down aviation in the state of Texas for daring to enact legislation to criminalize intrusive pat-downs currently conducted at airports. If allowed to continue this practice, federal government goons will be sticking their hands down the pants of citizens at malls, hotels, theme parks, and on streets across America.
The TSA has now turned into a literal occupying army threatening to completely change the character of American society from a beacon of liberty to a checkpoint-riddled, “show us your papers” Sovietized hellhole.
It is imperative that we not stand idly by while the federal government resorts to mafia-style threats of financial terrorism to crush the lawful and constitutional rights of local representatives to run their own state in the way they see fit.

DOJ resorts to economic terrorism, lawmaker compares fight to revolutionary war against Mexico
An astounding Department of Justice threat to cancel airline flights to and from Texas, in addition to underhanded lobbying by TSA representatives, has killed efforts in the state to pass HB 1937, a bill that would have made invasive pat downs by TSA agents a felony.

David Dewhurst, Speaker Joe Straus, the House Clerk, and the Senate Secretary, U.S. Attorney John E. Murphy threatened to cripple the airline industry in the state if legislators did not back down.
“If HR [sic] 1937 were enacted, the federal government would likely seek an emergency stay of the statute,” Murphy wrote. “Unless or until such a stay were granted, TSA would likely be required to cancel any flight or series of flights for which it could not ensure the safety of passengers and crew.”
“We urge that you consider the ramifications of this bill before casting your vote,” Murphy added.
The fact that Murphy can’t even get the name of the bill correct is almost as disconcerting as the rampant mafia-like attitude of the DOJ in using de facto economic terrorism to shoot down the legislation.
Following a fiery debate in the Texas House last night ( http://www.lonestarreport.org/Home/tabid/38/EntryId/1176/DOJ-warns-Texas-Senate-against-anti-groping-bill-UPDATE-HB-1937-pulled.aspx ), Senate sponsor Dan Patrick (R-Houston) pulled the bill, remarking that TSA representatives had been “lobbying” the Texas Senate in an effort to mothball the legislation.
“I will pull HB 1937 down, but I will stand for Liberty in the state of Texas,” Patrick said.
Patrick added ( http://www.texastribune.org/texas-legislature/82nd-legislative-session/fed-threat-shuts-down-tsa-groping-bill-in-texas/ ) that TSA officials had warned him passing the bill “could close down all the airports in Texas,” which he regarded as a ‘heavy handed threat’ by the federal government.
The staff of Rep. David Simpson said the DOJ had “thrown down the gauntlet” in using such stark language to oppose the bill.
“Either Texas backs off and continues to let government employees fondle innocent women, children and men as a condition of travel,” the staff wrote, “or the TSA [Transportation Safety Administration] has the authority to cancel flights or series of flights.”
“… 97 percent of people who go though the nation’s airports do not go through these offensive searches. And yet, a United States Attorney warns that flights to Texas could be shut down because TSA would not be able to ensure the safety of passengers and crew if agents could not touch genitals. Someone must make a stand against the atrocities of our government agents …”
In a point by point refutation of the DOJ letter, Simpson compared the battle against the TSA to the Texas revolutionary war against Mexico, writing, “Gentlemen, we find ourselves at such a watershed moment today. The federal government is attempting to deprive the citizens of Texas of their constitutional rights under the Fourth Amendment of the United States Constitution and Article 1, Section 9, of the Texas Constitution. If we do not stand up for our citizens in the face of this depravation of their personal rights and dignity, who will?”
The fact that the Department of Justice and the TSA have resorted to threats of economic terrorism in addition to underhanded lobbying techniques again illustrates the fact that the federal government is increasingly behaving like a criminal enterprise with total disregard for the Constitution.
The TSA’s initial response to HB 1937 was to claim that it could not become law because it violated the Supremacy Clause of the U.S. Constitution (Article. VI. Clause 2), a law that the TSA claimed “prevents states from regulating the federal government.”
In reality, this was a complete fabrication.
“The statement is false. Ignorance from the TSA is unlikely, so I’ll call a spade a spade. They’re lying. The supremacy clause says nothing of the sort,” reported Michael Boldin of the Tenth Amendment Center.

Despite the fact that the federal government has resorted to thuggish intimidation tactics to kill the anti-grope down bill in Texas, this only marks the latest chapter in an epic states’ rights battle that has centered on the agenda of the TSA to become a literal occupying force in America, manning internal checkpoints that will litter the entire country. |

TSA To Texas: Do It Our Way, or Drop Dead

This week, the TSA and federal government threatened the Texas state legislature to halt legislation that would classify TSA airport security procedures as a criminal felony or else face the reality of across the board flight cancellation in Texas. Texan lawmakers reluctantly obeyed in the face of Soviet-style tactics.
The anti-TSA legislation was passed in the Texas House by a vote of 138-0 before state senators were railroaded by the Department of Justice. Paul Joseph Watson of Prisonplanet.com reports:

The idea that America is even tolerating the existence of a federal agency like the TSA is a sign that things are rotten. It is clear by now that the TSA is not interested in providing security or stopping terrorists from getting on airplanes. Since its inception the TSA (Tyrants Screwing America) has crossed line after line in its anti-American campaign to turn Americans into full-fledged slaves of the criminal tyrants who hijacked America's federal government and staged the 9/11 attacks to take away the freedoms of the American people and destroy the foundations of America's constitutional republic.
The problem of terrorism has been engineered and manufactured by power-hungry traitors in Washington in order to assert total government control over the American people, their representatives, and industry. Other governments around the world have followed suit. It is undeniable that the West is being brought under a dictatorial, global, technofascist government in the name of saving society and making the people safe.
It is scary to think that the godfathers of terrorism are not reading the Koran for their inspiration but RAND Corporation documents and secret White House memos, but it is true. And we know this is true because there is scientific, circumstantial, forensic and political evidence which proves that the official 9/11 story is a giant myth that was invented by professional myth-makers and psychological experts like Philip D. Zelikow, Paul Wolfowitz and Richard Perle to indoctrinate the American people along with the people of the world and prevent individuals from thinking critically about what their governments tell them about terrorism.
On Wednesday May 25, 2011, Alex Jones asked the citizens of Texas to protest at the State Capital in Austin against the intrusion by federal goons who are violating the U.S. constitution and treating the American people like cattle. The tyrants and terrorists who have taken control of the federal government like to pretend that the American people have no voice. But Texan lawmakers have proven otherwise through their act of disobedience against the TSA. Alex Jones is also reminding the terroristic parasites in Washington that the American people are not helpless little children who can be silenced, robbed, and deceived forever.
What terrifies the deceitful and traitorous establishment in Washington is that the American people have a voice and a memory of resistance to tyranny. The psychopaths and pedophiles who make up Washington's hidden establishment are weaklings compared to the honest and good people who have embraced the spirit of freedom and defiance. The traitors in Washington have done nothing except start criminal wars in the name of defense, steal trillions of dollars from the American people in the name of economic recovery, and institute a regime of repression and terror in the name of security.
Washington's demonic liars have twisted everything to advance their agenda of tyranny and turned America on its head. In place of the U.S. Constitution they have implanted into the social and legal fabric of America the USA Patriot (Traitor) Act. Instead of providing opportunities for Americans to attain true economic and personal security they have given the American people a pack of sadistic wolves known as the TSA workforce and called it a "security administration." You get the drift. America's ruling elite is not defending America but conducting war on American society, the American people, and the American spirit. They are a thousand times more dangerous, despotic and cruel than King George III. May they fall a thousand times harder. |
